Motor Vehicle Act, 1939

This Act was ammended in 1982               and notified vide notification  dated 1st October,1982. It relates to Solatium for victims of Hit and Run (by unidentified/intraced vehicles)

 

-                       District level Committee is setup under this Act. "Claim Enquiry Officer (SDM), District Transport Officer (Member) Claim settlement Commissioner–cum-District Magistrate.

-                     Claimant, who met with an accident should give an application six months before the accident date. After the enquiry is over , the applicant (legal heir of deceased) is awarded a Solatium of Rs. 25,000/-. However, if claim is regarding injury, the claimant can be given a maximum amount of Rs. 12,500/- proportionate to injury. The amount is paid though General Insurance Company.

This Act received the assent of the Lieutenant Governor of the Punjab on the 3rd May, 1911 and that of the Governor-General on the 7th July, 1911, and was first published in the Punjab Gazettee of the 11th August, 1911. It relates to Municipal Act in Constitution of Committees, Election of Presidents etc. Now, vide 74th Constitutional Amendment. The Act has been amended drastically and the amendent has been proved a milestone in the history of legislation. This amendment has ensured decentralisation of powers at the grass-root level.It deals with :-

 

-                     Constitution of Committees.

-                     Under this act the elections of President and Vice President are conducted.

-                     In this act the conduct of Business is done as holding the times of meetings, ordinary and special meetings, To elect the Chairman of the meeting, vote of majority decision etc.

-                     Delegation of powers.

-                     To check the procedure for Assessing Inmovable Property.

-                     Way of prevention and extension of fire.

-                     The powers of Sanitary.

-                     Powers to prohibit use for human habitation of buildings unfit for such use.

-                     Places for slaughter of animals for sale and also disposal of dead animals.

-                     Punishment for immovable encroachment or overhanging structure over street.

-                     Maintenance of funds relating to  the taxation, contracts.

-                     The powers to suspend any resolution or order of committee.

-                     Inquire generally into the affairs of a committee. or joint committee with a view to ascertaining whether a municipality is being satisfactory.

-                     Resolution relating to appointments in Municipal Committee or payments of loan.

-                     Under this act " No confidence motion" is passed and is almost akin to electing an office-bearer such resolution cannot be passed by mere raise of hands. Voting shall be by secret ballot.

-                     Penalty on member, officer or servant being interested in any contract made with a committee.

-                     President of the committee authorising a contractor to do the work in anticipation of committee's approval.

-                     Power to prevent extravagance in establishments.

-                     Resolution of Committee regarding appointment.
