Peshi Deputy Commissioner: 

 

 Court work:   Under section 6 of the Punjab Land Revenue Act, 1887,  the Deputy Commissioner  exercises the powers of District Collector of a district. Under section 11 of the Act ibid, he exercises control over all revenue officers in the district. Following types of cases are decided by him under the Act :-

 

Appeal mutation :

 

       Procedure: A party aggrieved by the order of Assistant Grade –I, files an appeal before the District Collector, under section 13 of the Punjab Land Revenue Act, 1887. After the appeal is presented, it is marked to the Reader for summoning of parties and record of lower court after completion of necessary formalities. File comes to  reader for  numbering and to ensure that the same is complete  in all respects.  Reader scrutinizes  the same  and ensures  whether  appeal is within limitation, necessary parties have been impleaded,  No. of copies of appeal have been presented corresponding  to the  number of  respondents, Power of attorney or Memorandum of  appeal have been duly signed by the counsel for the parties or  appellants in person as the came may be. He further ensures that the Talbana and  power of attorney are duly stamped worth Rs. 50/- and Rs. 5/- respectively. After scrutiny, he causes the appeal to be entered and numbered in the Mislband Register. After the appeal is found in order keeping in view the above formalities, the case is listed for arguments and decision. After decision on merit, the appeal file is consigned to the record room, whereas the lower court file is sent back to the concerned court.

Channels of supervision :

ii)                 District Collector (exercises appellate jurisdiction in deciding appeals against the orders of Asstt. Collector 1st Grade ). At both levels records are maintained by Ahlmed and supervised by Reader.

iii)               Assistant Commissioner ( Grievances ) ass Branch Officer ).

Accountability: Reader and Ahalmad are  responsible for implementation of  interim/ final orders passed by the Presiding Officer on each file. There are 3 Record Rooms in the District of Sangrur viz. Sangrur, Barnala and Malerkotla for six sub Divisions.The records pertaining to Sub Divisions of Sangrur, Sunam and Moonak are consigned at Sangrur, those of Dhuri & Malerktola consigned to Malerkotla Record Room and Record pertaining to Barnala Sub Division is consigned  at Barnala.

Appeal Rent Suits:

 

These appeals are filed under the Pepsu Tenancy Act. The orders of Asstt. Collectors of 1st Grade are challenged before District Collector.

Procedure :  The procedure for deciding the Rent Suit appeals is the same as in case of mutations, except  that in such cases  Ad valorem Fee is charged in form of Non-judicial stamps at both levels i.e. while presenting Original suit before Asstt. Collector 1st Grade and at the time of filing appeal before District Collector. This Ad valorem is charged as per chart issued by the Hon'ble Punjab & Haryana High Court. Normally it is Rs. 48.80 on every 5,000/- or part thereof, upto Rs. 4.0 lacs ( suit value ).

Channels of supervision : Assistant Collector 1st Grade ( whose order is challenged in appeal and District Collector (exercises appellate jurisdiction in deciding appeals against the orders of Asstt. Collector 1st Grade ). At both levels records are maintained by Ahlmed and supervised by Reader, Assistant Commissioner ( Grievances ) as  Branch Officer ).

Appeals under the Public Premises Act, 1973:

 

                   Under the Public Premises Act, 1973, the  District Collector exercises the powers of Divisional  Commissioner. He hears appeals emanating from the orders of Collector of the Sub Division, whereby  the Collector orders removal of encroachments on public properties.

Procedure:  The procedure to decide  these appeals is also the same as in Mutation cases, except that no court fee / ad valorem is charged.

Channels of supervision :  Collector ( whose order is challenged in appeal and District Collector ( in exercise of the powers of the Divisional Commissioner ). At both levels records are maintained by Ahlmed and supervised by Reader, Assistant Commissioner ( Grievances ) as Branch Officer.

Accountability: Reader and Ahalmad are  responsible for implementation of  interim/ final orders passed by the Presiding Officer on each file. Ahalmad is further responsible for consignment of appellate record to the concerned record room and return of  lower court record to the concerned court.

Cases under section 47-A of the Indian Stamp Act, 1899.

              Under this Act, the Deputy Commissioner in exercise of powers of  District Collector, decides cases of deficiency of stamp duty levied on  various documents  i.e. sale deeds, gift deeds etc. presented before the Joint Sub Registrar/ sub Registrar, who impounds the same on the ground of levy  of stamp duty not in accordance with  Market Rates or the  prevailing Rates determined by the District Collector annually.

Procedure:  The procedure to entertain  these appeals is also the same as in Mutation cases. After the case is  numbered  in the Mislband Register, the same is put up before the District Collector. Buyers and sellers are parties to the case. They are required to file reply and adduce evidence in support of their claim. Some times, a report is also sought from concerned Sub Registrar/ Joint Sub Registrar or other officer within the department before deciding the case finally.

Channels of supervision :Sub Registrar/ Joint Sub Registrar ( who impounds and refers the document/ deed  ), and District Collector (exercises original jurisdiction in deciding  the cases so referred U/s 47-A of the Indian Stamp Act, 1899  ). At district  level records are maintained by Ahlmed and supervised by Reader.

Accountability: Reader and Ahalmad are  responsible for implementation of  interim/ final orders passed by the Presiding Officer on each file. Ahalmad is further responsible for consignment of appellate record to the concerned record room and return of  lower court record to the concerned court.

Election Petitions:

Vide Notification  dated 22nd June, 2001, issued under Section 73 (2) of the Punjab State Election Commission Act, 1994, Deputy Commissioner, Sangrur has been appointed as Presiding Officer of the Election Tribunal at the District level for deciding election petitions in respect of Elections to  Municipal Committees, Nagar Panchayats and Gram Panchayats for Barnala an Sangur Su Divisions in the district.

Procedure:  The procedure to entertain  these petitions is also the same as in Mutation cases. After the case is  numbered  in the Mislband Register, the same is put up before the Presiding Officer of the Election Tribunal. Notice to all concerned parties is issued for putting their appearance before the Election Tribunal. After the respondents appear, they are asked to file their reply to the petition. The petitioners can also file replication to the reply filed by  respondents.  Thereafter, issues are framed  after hearing the  parties and on the basis of issues, the parties are  directed to adduce their respective evidence in support of their claim. The procedure is governed by the Code of Civil Procedure.

Cases under Package Deal Act:

 

                   Under the Package Deal Act, Deputy Commissioner exercises the powers of Chief Sales Commissioner-cum-Deputy Commissioner and hears/ decides the appeals emanating from the orders of Sales Commissioners-cum-Sub Divisional Magistrate. The cases pertain to the rehabilitation properties sold/ allotted  by the Sales Officer-cum-Tehsildar.

Channels of supervision : Sales Officer ( Tehsildar ), Sales Commissioner (SDM )  and  Chief Sales Commissioner ( Deputy Commissioner )

Appointment of Lambardars:

Appointment of  Lambardars is made by the Deputy Commissioner under rule 14 of the Punjab Land Revenue Rules.

Procedure :-   As and when a  vacancy of Lambardar arises in the village, the concerned  Circle Revenue Officer gets the proclamation made in the village in order to invite claims from the aspirants. The proclamation can be made through beat of drum or otherwise. The CRO concerned hears the claims of the candidates, gets  their antecedents verified from the local police and recommends the names to the SDM through Tehsildar.  SDM again hears the parties and recommends the name of the candidate, if he finds him suitable. If there are more than one contestant, he forwards the case to the District Collector, who appoints the candidate as Lambardar, whom he considers more or the most  suitable. If the appointee happens to be  the sole contestant, " Sanad" of appointment is issued to the candidate within a period of 15 days from decision of the case. In case, the Lambardari is contested by more than one candidates, then 'Sanad' is issued after expiry of limitation period for filing an appeal before the Divisional  Commissioner.

Transfer of cases:

 

Section 12 of the Punjab Land Revenue Act envisages that " Collector may by written order distribute in such manner, as he thinks fit, allocate any business cognizable by any Revenue Officer under his control. He may also withdraw any case pending before any Revenue Officer under his control and either dispose off it himself or by written order, refer it for disposal to any other Revenue Officer under his control."

 Procedure :      On an application filed by  either party to the revenue proceedings before any revenue officer under the control of Deputy Commissioner-cum-Collector, that it has no faith and hope of justice from a particular court, the Collector seeks comments from the Presiding Officer of the said court and transfers/ withdraws the case from that court, if he is satisfied that it is necessary in the interest of justice. He may transfer any case from one court to another quo moto also.

Consignment of Records:

 

          After the case is decided, a challan is prepared in triplicate ( 2 copies for record room and one for office ) and sent to the Record Room alongwith files  numbered and entered in the challan. After allocation of Goshwara number by the Record Room Official, one copy of the challan is returned to the Peshi DC Branch. The Goshwara number is entered in red ink by Ahalmad in the Mislband Register so that in future it is easier to locate the concerned case file.

Appointment/ removal and dismissal  of  Chowkidars ( village  watchman ) is made by the SDMs, against whose decision appeal lies before the  Deputy Commissioner. Deputy Commissioner, Sangrur delegated these powers to Additional Deputy Commissioner, Sangrur under para 42 of the Punjab Chokidara  Rules.

Sanction of  emergency leave/ furlough /parole and pre-mature acquittal of  prisoners.

 

Procedure :  Emergency leave is granted by the District Magistrate to the prisoners in dire need.  Leave roll is received from jail authorities specifying the nature of emergency i.e. death/ marriage of some blood relation of the prisoner. On the basis of the said roll, the dealing clerk puts up the case with instructions. The case is scrutinized by  the reader and branch officer and is submitted before District Magistrate for grant of emergency leave.  Normally jail authorities recommend 15 days leave. However, it is discretion of the District Magistrate to curtail the leave period depending upon  circumstances of each case.

          Furlough and premature acquittal are sanctioned by the Secretary, Home Department, Punjab on the recommendations of  I.G. Prisons, Punjab.

          Parole is granted  by Inspector General, Prisons, on the recommendations of  District Magistrate. A report regarding law & order is also obtained from SSP, Sangrur by the District Magistrate before recommending  Parole for sanction under section 3(1) of the Punjab Good Conduct Prisoners ( Temporary Release ) Act, 1962. If the convict wants to go on parole within next one year, no police verification is not again  required. Breach of peace is not a good ground for refusing the grant of parole to a convict.

Enquiries against police officials:

 

Procedure :-  Enquiries against police officials are conducted  under rule 16.38 of the Punjab Police Rules, 1934.  District Magistrate may either enquiry  by an Executive Magistrate or may order  the judicial prosecution of the delinquent police official. He may order such enquiry either on the recommendation of Senior Supdt. of Police of the district or on the basis of a public complaint. After the enquiry is completed, the prosecution shall follow if the charges are proved against the official. Information is sent to the Senior Supdt. of Police concerned.

Custodial Deaths

 

Procedure:        As and when a prisoner dies in the custody of jail authorities, information is received by the District Magistrate through TPM. District Magistrates immediately orders an inquest under section 176 of the Cr. P.C. through a Sub Divisional Magistrate and also informs the National and State Human Right Commissions regarding the said death. In order to ensure an independent enquiry  video cassettes/ post mortem and viscera reports are also sought from the concerned authorities. These reports  are relied upon during  magisterial inquest. If the guilt of the jail authorities is proved,  Senior Superintendent of Police is requested to take appropriate action as per law.  Normally, criminal proceedings follow. The information is also sent to the National and State Human Right Commissions, apart from the Secretary to Govt. of Punjab, Department of Home Affairs and Justice, Chandigarh.

Withdrawal of Prosecution Sanction:

 

Procedure:        As per Punjab Govt.  Memo No. 4787-4JJ-76/9349  dated 17.3.1976, District Magistrates are empowered to order withdrawal at their own level criminal cases  involving offences punishable with imprisonment not exceeding five years,   cases against Govt. employees,  Cases regarding mis-appropriation of, damage to and destruction of Govt. property; and  cases  of public or political importance likely to receive publicity or cause political repercussion.  All other cases have to be referred to the Govt. for prior approval. Such case are received either from Govt. or from the individual. Report from concerned SSP is obtained before recommending/ ordering the withdrawal. Sometimes, enquiry by a magistrate is also got conducted in cases against the Govt. employees. Advice of District Attorney is also received.

State Appeals:

 

Procedure :  As per Section 378 of the Code of Criminal Procedure, 1973, cases for State Appeals are received from the District Attorney, Sangrur for approval of the District Magistrate, Sangrur and onward transmission to the Director, Prosecution, Punjab, Chandigarh for filing appeals in the Hon'ble Punjab and Haryana High Court.  As per Amended Act, 2005, in order to guard against the arbitrary exercise of power and to reduce reckless acquittals, section 378 is being amended to  provide that an appeal against an order of acquittal passed by a Magistrate in respect of a cognizable and non-bailable offence filed on a police report, would lie to the Court of Sessions and the District Magistrate will be authorised to direct the public prosecutor to file such appeals.

Police Protection Cases:

 

          Police Protection is given in cases of Warrant of possession, demarcation, removal of illegal encroachment over Govt. lands as well as from the lands of Nagar Panchayats/ Nagar Councils. The competent authority to provide Police Protection is the District Magistrate under rule 2 Chapter 7 J of Punjab and Haryana High Court Rules and Orders ( Vol. IV). An amendment has been carried out in the above rule on 6.8.1992 by the Govt. of Punjab that in cases of execution of degree and other cases, the power of granting police protection will be exercised by District & Sessions Judge, directly. However, he has to endorse a copy to the District Magistrate, who further endorses the same to the Senior Supdt. of Police concerned.

Procedure:  A case for providing Police Protection is forwarded by the concerned Sub Divisional Magistrate with his recommendation that in a particular situation, protection is required.  Accordingly, after considering the proposal the police protection is granted with a copy to the concerned Senior Supdt. of Police.

General Provident Fund ( GPF Branch )

 

          Refundable and Non-refundable advances from the G.P. Fund are  sanctioned  to Class III and IV employees through this Branch under rules 13.14 and 13.29 respectively  of the Punjab Civil Service Rules, Vol.II.  Refundable Advance can be obtained  for the purposes of social ceremonies in the family of the employee such as marriage, Mundan, Dastarbandi etc. Minimum Service for being eligible for seeking advance ( refundable ) is 5 years. The employee seeking advance is required to attach alongwith his application, the statement showing his deposits during the current financial year and an affidavit to the effect that he shall use the GPF for the purpose for which it is being withdrawn.

          Non-Refundable advance can be obtained for the purposes of  building/ repair/ alteration/ addition, purchase of plot, scooter, car, litigation expenses. The amount of withdrawal should not exceed  half of the deposit in the account or six month's basic pay whichever is less. Advance under this clause for the purpose of marriage/ engagement or studies of children can be given upto ¾ of the total amount lying in the GPF provided that minimum service of the employee should have been 20 years or he should have less than 10 years of service in his superannuation.  For Scooter/ motor cycle, computer and  car an advance of Rs. 30,000, Rs. 60,000/- and Rs. 2,50,000/- can be obtained. Different registers are maintained for Class II, III and IV officials.  Apart from that GIS account of Class III and IV of the office of Deputy Commissioner is also maintained.

Employee is exonerated or proceeded against as per enquiry report after granting personal hearing.           This Branch deals with the cases under Indian Arms Act, 1959 and Arms License Rules, 1962. Apart from that Fire Works licenses under Explosive Act and NOC for retail out let/ gas agencies are  also issued. The following types of cases are dealt in:-

Issue of new arms license:

 

Procedure :-      An application for issue of non-prohibited bore revolvers/ pistol/ gun is submitted by the concerned applicant at the Single Window alongwith  proofs of date of birth, residence, medical fitness and an affidavit that no criminal case is registered against the applicant; that he is applying for the same for the first time and  for self defence. The application is processed in the LPA branch, photograph of the applicant is taken in the computer and the application form is sent to the Senior Supdt. of Police concerned for police verification. After the police verification is received, the applicant is directed to appear before the District Magistrate for personal hearing, who either rejects the case, or keeps it pending or grant license. The license is valid for 3 years  from the date of issue and the licensee can purchase the weapon within a period of one year from the said date. No further extension can be granted in any  case after one year. A licensee can have maximum 3 weapons  against the license.  The license is valid for Punjab State only. License valid for all India are issued by the Department of Home Affairs and Justice, Punjab, Chandigarh.

The application is then  processed in the LPA branch, where after seeking a report of SDM regarding legal heirs and nominee, the order of   District Magistrate are obtained. The legal heirs are given 6 months' time either to dispose of weapon to a licensee or get it transferred in the name of any legal heir in whose favour there is a valid license.

          Under the above section prohibitory orders banning assembly of more than 5 people, processions etc., plying of loud-speakers,  parking in bazaars, carrying lethal weapons, regulating times for harvesting, banning use of pressure horn on vehicles, sale of intoxicants, digging of wells without permission, and certain prohibitory orders during festivals are issued.

Procedure :       Before issuing such orders reports/ NOCs from the concerned Senior Superintendents are received.  The above orders are issued for sixty days.  After a notional break of one day  the period is extended for next sixty days, after seeking similar reports again.

Procedure:  As an when a tour programme of some VVIP/ VIP is  received, concerned Senior Supdt. of Police is directed to make security arrangements.  In case of a  public function involving  large gathering, X.En. PWD, Provincial Division is asked to arrange barricading of the  rally place. Civil Surgeon has to provide medical team alongwith  blood matching the group of VVIP/ VIP. All concerned are directed to be present during the visit of the VVIP/VIP. Other arrangements include booking of rest house, parking passes, invitation cards, press arrangements and fire fighting arrangements.

Procedure:   An application ( 8 copies ) supported by the proof of ownership, where the business has to be started and an affidavit is submitted by the Applicant.  Reports from the concerned Senior Supdt. of Police, SDM, X.En. PWD, Executive Officer of the Nagar Council ( in case site is in a town ), DDPO ( in case site is in a village), X.En. PUDA and Divisional Town Planner are sought as to whether the setting up of a Video Parlor, Cinema or Marriage palace conforms to the norms of Govt. Instructions and whether they have any objection against the proposal. After the reports are received in affirmative, the case is examined and processed  for approval of the Deputy Commissioner for construction of the building on the site in question.  After the building is complete  concerned SSP, SDM, X.En. PWD, X.En. Public Health, Fire Brigade and Electrical Inspector submit their reports regarding safety measures. Procedure:   An application  supported by the proof of death or injury, a copy of F.I.R.  and an affidavit is submitted by the Applicant within six months of the accident.  Report from the concerned SDM, who is the claim enquiry officer as per law, is sought. In case claim is time barred but within one year of the accident, the claim enquiry officer ( SDM ) can condone the delay. After the report is received from the SDM, the case is processed and submitted for decision to the Claim Settlement Commissioner-cum- Deputy Commisioner. In case of approval, the Oriental  Insurance Company is directed to make the payment to the tune of Rs. 25,000/- in case of  death and Maximum Rs. 12,500/-  in case of injury.

A report is sought from the SSP concerned as to whether the police has any objection in the proposed change of name. After the report is received from the SSP, the case is processed and submitted for decision to the Deputy Commisioner. Procedure:  An application  supported by the proof of death or injury,  and an affidavit is submitted by the Applicant  in the office of concerned Market Committee.  Market Committee requests the Deputy Commissioner to make an enquiry through concerned SSP and the SDM.  Accordingly, reports are sought from both the authorities. After the reports are received from the SSP and SDM, the case is processed and submitted for decision to the Deputy Commisioner. In case of approval, the case is returned to the Secretary Market Committee to grant compensation to the legal heirs of deceased or the injured person as the case may be.  In case of death, the legal heirs are given Rs. 75,000/-. However, in case of injuries, the amount is determined in proportion to the  injury.

Procedure :  An application for issue of a passport is  received at the  District Headquarter through Single Window of Deputy Commissioner's office.  Passport issuing authority lies with  the Regional Passport Officer, Chandigarh.  Application supported  by a demand draft of Rs. 1,000/- in the name of  RPO, residence proof and date of birth proof is received and processed at Single window.   A report regarding character verification in respect of  applicant is sought from SSP concerned.  After the receipt of character verification report, the case is forwarded to the RPO, Chandigarh for issue of a passport.   Processing fee is Rs. 100/- charged by District Sukhmani Society, Sangrur. Application for issue of a  Passport in favour of minor children can be submitted by  their guardians. Fees is Rs. 600/-. A copy of passport of the parents is also required to be furnished. Procedure :  The license for practicing as a Notary Public are issued by the Secretary to Govt. of Punjab, Department of Home Affairs and Justice on the basis of penal received from the Divisional Commissioner and Deputy Commissioner.  Power to renew also vests in the Department of Home.  A Notary Public's license is valid for 3 years and after 3 years, the applicant  applies to the Home Department  for Renewal  for next 3 years. Home Department seeks reports regarding work and conduct of the Notary Public from the District & Sessions Judge  as well as Deputy Commissioner.  Deputy Commissioner after obtaining reports from the concerned SDM and District & Sessions Judge, forwards the same to the Divisional Commissioner, who in turn transmits the same to the Department of Home for renewal.

District Transport Officer is the convener. He is  requested to dispose off the vehicle through open auction  after following the due procedure as provided in the Govt. instruction. The money received from sale of the vehicle is deposited in the Govt. treasury.

It is for the Court to determine whether the said person is pauper or not.

After the articles are purchased, they are entered into stock register and distributed amongst concerned officers/ officials. In token of receipt, their signatures are obtained.

The highest bidders are  allocated the work. Earnest money and installments are received as per Govt. instructions. Final approval is given by the Deputy Commissioner.

Procedure :  The power to allot space for placing kiosks in the Courts Complexes ( Judicial and revenue ) at the district headquarter vests in the Deputy Commissioner.  Whenever an applicant or applicants submit and application for allotment of such site, a report from the concerned SDM is obtained. On the receipt of the report regarding availability of site, the  site is allocated on merit basis.  At Sub Divisional/ Sub Tehsil level this power vests in the  Sub Divisional Magistrate concerned.  SDM  also allocates the site after seeking a  similar report.

Procedure:   It is the duty of the Police  under section 25 of  the Police Act to  report  to the District Magistrate regarding unclaimed property recovered by them. If any person thereafter approaches the District Magistrate and stakes  the claim over the property recovered by the police, the District Magistrate seeks an NOC from the concerned  Senior Supdt. of Police. If the concerned SSP has no objection, the property is released to the claimant on spurdari.

DISTRICT REVENUE ACCOUNTANT

 

          This breach deals with the cases pertaining land acquisition for  public purposes under the Land Acquisition Act, 1894, recovery of arrears of land revenue under the Punjab Land Revenue Act, 1887,  recovery of abiana, chowkidara, mutation fee, copying fee, local rate and Kishtbandi,  Rehabilitation and Nazool land  and settlement of audit paras.

 

Acquisition of land under the Land Acquisition Act, 1894 read with Standing Order No.28.

 

Procedure : As and when a request from any Department is received that they want to acquire  land ( less than 25 Acres in case of rural land and  less than 5 Acres in case of within the  periphery of municipal towns) ,  the request is considered  by the Site Selection Committee headed by the Deputy Commissioner. The other  members are Chief Agriculture Officer, Divisional Town Planner,  Superintending Engineer, PWD,  ( B&R ), Superintending Engineers of Drainage Public Health and Irrigation  Departments The committee selects 3 sites and proposes the same to the acquiring department. If the  acquiring department agrees to the site selection, NOC is issued to the department in consultation with  the above mentioned site selection committee.  Thereafter, a meeting of the District Land Price Fixation Committee meeting is held to finalise the rates of the land being acquired.  After the rates are fixed, Secretary of the concerned acquiring department  issues a notification under sections 4 and  of the Land Acquisition Act, 1894.  The claims, counter claims and objections if any, are heard and decided by the acquiring department. Thereafter award is approved by the  District Collector, if the amount is  upto Rs. 50 lacs. In case  the amount of total award exceeds Rs. 50 lacs, the award will be approved by the Administrative Secretary of the acquiring department. If the land to be acquired exceeds 25 acres in rural areas and 5 acres in urban areas, the  competent authority is the  State level Land Acquisition Board ( headed by the Financial Commissioner, Revenue, Pb ).

The office of the Deputy Commissioner by taking periodical reports ensures that the paras so pointed are settled well in time and as per law.

Any deficiency in working of any revenue officer or special work done is recorded in the proceedings, which is conveyed to all officers.

Procedure :The  Nazool land is disposed off under  the Nazool Land  (Transfer) Rules, 1956.  The land is leased on annual basis. District Collector has power to approve the auction of nazool land involving lease amount worth Rs. 5000/-  or below per year. The lands are put to open auction every year before March and  the bid has to be approved before 31st of March.

        SALE/ ALLOTMENT OF REHABLITATION PROPERTY

 

Procedure :  This type of land was to be allotted to the persons migrated from Pakistan in lieu of property  left by them in Pakistan in the wake of partition.   This type of land is also  allotted to the persons who died/ were  fully disabled in army action during 1962 Chinese Aggression, 1965 and 1971Indo-Pak wars.

          This branch mainly deals  with  flood situation and recovery of  bank loans.

 

Flood Preparedness and other natural calamities :

 

Procedure :  Any persons who applies for grant of  compensation in lieu of damage caused by flood and other situations like drought, fire, rains and hailstorms etc. is awarded an amount of compensation,  assessed by the revenue agencies in consultation with the girdawaris in case of  crop loss and by other methods of assessment in case of loss to other properties.  After the amount of relief is received from the Govt., it is disbursed through revenue officials to the applicant, if found eligible for grant of compensation.

Recovery of  Arrears/ loan under  Section 14 of Securitisation Act:

 

 

Procedure: Such cases are received from Banks. Notice to the defaulter is given. If  the parties fail to reach an agreement  during the notice period, an order u/s 14  of the Act is passed and revenue officer concerned is directed to take over the possession of the property pledged by the loanee and make over possession to the bank.  Thus, recovery of loan is ensured under the above Act.

          This branch issues copies of various documents  like court orders passed by the Tehsildars/ SDMs/ Additional Deputy Commissioner and Deputy Commissioner  in their capacity as Presiding Officer of the Court. Copies of mutations, Jamabandis, Khasra Girdawaris, demarcation, Mussavi, statements given various court cases/ enquiries pending or disposed off, copies of field book etc.

Procedure:  An application  is submitted by the applicant at the Single Window of the office of Deputy Commissioner, which is received in branch and processed.  After obtaining orders from the competent authority under the provisions of Copying Manual, certified copy is sent to the Single Window for delivery to the applicant.

MAINTAINANCE OF RECORD ROOM

 

          Files pertaining to orders passed by Revenue Officers in Sangrur, Sunam and Moonak Sub Divisions are consigned to the record room at Sangrur. Some times files are requisitioned by the higher court like Divisional Commissioner and Financial Commissioner, Revenue, Punjab.  These  files are sent to them and on returned consigned to this record room.

Procedure of Consignment of record:        After the case is decided by a Court, a challan is prepared  by Peshi Branch in triplicate ( 2 copies for record room and one for office ) and is received in  the Record Room alongwith files  numbered and entered in the challan. After allocation of Goshwara number by the Record Room Official, one copy of the challan is returned to the concerned court.  The Goshwara number is entered in red ink by Ahalmad of the Court  in the Mislband Register so that in future it is easier to locate the concerned case file.

RELIEF AND RESETTLEMENT BRANCH:

          This branch deals in cases pertaining to grant of compensation, subsistence allowance and ex-gratia grant to the persons affected by  1984-riots/ terrorism. In case of death of a person legal heir dependent on the deceased till death  is provided a job by the Govt.

Procedure :  As and when an application is received from  the victims or their legal heirs ( in case of death ) claiming  compensation etc. the same is processed and sent to the concerned SDM for enquiry and report.  For terrorism affected persons all benefits are given by the SDM concerned, who  is the Drawing and Disbursing Officer and  is responsible for  issue of  identity Card/ Bus Pass and Marriage Grant/ expenses for studies of children and  also subsistence allowance etc. However, where  the victim's dependent has sought employment, after an enquiry  regarding correctness of the claim, the  case is referred to the Deputy Commissioner, who in turn recommends to the Govt. of Punjab for appointment as per Govt. instructions.

          Recently Compensation to the tune of Rs. 2 lac per family is being given to  the 1984-riots affected persons after verifying their red cards and proof of residence.

          COMPLAINT AND ENQUIRY BRANCH:

 

                   This branch deals with the grievances redressal mechanism. Apart from daily hearing of public complaints,  the Govt. has evolved speedy mechanism for the convenience of the people. Sangat Darshan and Suvidha Camps are two such instruments, whereby justice is ensured to the public.

 

Sangat Darshan:

 

          Sangat Darshan is organized on first and third Wednesday of every month to hear and redress the complaints at the spot. The complainants seek information about their  complaints in the CEA Brach, where two clerks one senior Assistant and one Superintendent help them. Deputy Commissioner himself or  the Assistant Commissioner (Gri. ) hear the complaints of the public every day.

to general public, where all the concerned departments set up their Counters for entertaining complaints etc. In addition  to it,  if any one puts Grievances, the same is redressed  on the spot. Public man can also see the Hon'ble Minister, Deputy Commissioner, Additional Deputy Commissioner under whose chairmanship Suwidha Camp is organized. In which case the matter is  required to be investigated, the same is handed over to the officer of the concerned department for inquiry and report and receipt is issued to the applicant.

The functioning of the branch is similar to that of Establishment Branch.
